CHAPTER-I

PARTICULARS OF ORGANISATION, ITS FUNCTIONS AND DUTIES

(A) Particulars of organization: The Government of Himachal Pradesh established the H.P. State Seed Certification Agency vide notification No.Agr.F-12-3/76-Vol-II, dated 27.12.1978. The Himachal Pradesh State Seed Certification Agency is registered under the Societies Registration Act,1860 (Act,XXI of 1860). The Agency started its independent working w.e.f. 26.10.78. The Agency adopted Memorandum of Association and rules based on the model pattern circulated by the Government of India. The Agency has also been entrusted the job of certification of organic farms and their produce and consequently its name has been changed to H.P. State Seed & Organic Produce Certification Agency (HPSSOPCA) vide notification No.Agr,F(10)-16/2003, dated 19.02.2004.

(B) Organizational and Administrative Set Up: Copy of the Organogram is annexed at Annexure-1. The Secretary (Agriculture) to the Government of Himachal Pradesh is the Ex-officio Chairman of the Agency. At present Mrs. Bharathi S. Sihag, I.A.S. is holding the charge of Secretary (AgricFulture)-cum- Chairperson, HPSSOPCA from January,2004 to date. The Director, H.P. State Seed & Organic Produce Certification Agency is the Chief Executive Officer of the Agency and also functions as Member-Secretary of the Governing Board. At present Dr. H.R.Noor, functions as Director of the Agency as well as Member-Secretary of the Governing Board. The constitution of the present Governing Board of the Agency is given below:

The Director, H.P. State Seed & Organic Produce Certification Agency is the Chief Executive Officer of the Agency and also functions as Member-Secretary of the Governing Board. At present Dr. H.R .Noor, functions as Director of the Agency as well as Member-Secretary of the Governing Board. The constitution of the present Governing Board of the Agency is given below:

a) Regional Office Palampur:- Seed Certification Officers, Agriculture Extension Officers, Field Assistants & Beldars have been posted at the following places for doing field inspections, tagging and sealing work as per the procedure laid down by the Central seed Certification Board in the Indian Minimum Seed Certification Standards under the immediate control of Chief Seed Certification Officer, Palampur as under:

Aims and Objectives
Seed Certification is a particular prescribed procedure through which genetic identity, physical and physiological purity and seed health is maintained in seeds and propagating materials of notified kinds and varieties. As a result, the certified seed is of known pedigree, high varietal purity and good seedling value and confirm to the prescribed field as well as laboratory standards in respect of genetical and physical purity, germination, moisture percentage and seed health.

Objective:

The main objective of the H.P. State Seed & Organic Produce Certification Agency is to maintain, provide and make available to the public high quality seeds of notified varieties and propagating materials and to ensure their genetic identity, known pedigree, high varietal purity and good seedling value. Certified seed has to meet the field as well as laboratory minimum standards in respect of genetic and physical purity, health and germination etc.

Functions & Duties:
The main functions of the H.P. State Seed & Organic Produce Certification Agency are as under:
  • To act as the Certification Agency established under section 8 of the Seeds Act, 1966 (54 of 1966).
  • To discharge the functions entrusted to the Certification Agency under Section 9 & 10 of the Seeds Act, 1966 (54 of 1966).
  • Diffusion of scientific knowledge regarding standardisation of seeds according to the National / International Standards.
  • To recognize varieties and kinds, where improved varieties are not available, eligible for seed certification and publish annually lists indicting the name of such varieties and kinds.
    • To maintain a list of source of breeder and foundation seeds approved by the Central Seed Certification Board in the case of varieties grown in more than one state and by the State Certification Board in the case of varieties of local importance.
    • To verify upon receipt of an application for certification that the application has been submitted in accordance with the procedure prescribed by the Central Seed Certification Board and that the source of seed, used for planting, is from approved sources.
    • To do the inspections of seed processing plant and seed lots in accordance with the procedure outlined by the Central Seed Certification Board.
    • To ensure that the seeds certified in the state confirm to the standards prescribed by the Central Seed Certification Board.
    • To carry out educational programmes designed to promote the use of certified seed.
    • To register organic farms, their inspections to ensure that only permitted materials are applied in such farms as per the national/ international standards.
    • To undertake promotional activities for organic farming in the state.
    • To have coordination with different departments of the State Government, Central Government and other Agencies.
CHAPTER-II

POWERS & DUTIES OF OFFICERS AND WORKMEN

Powers, duties of Officers and workmen are as under:

 Director:

  • act as the Chief Executive Officer of  HPSSOPCA and Member Secretary of GB.
  • Overall administration of HPSSOPCA and  execution of the Seed Certification Programme in the State.
  • Take decisions, on issues arising out of certification consistent with the CSCB’s and GB’s guidelines.
  • Report on the progress of seed certification, the problems and suggestions thereof GB and CSCB.
  • Appoint staff according to the powers prescribed by GB.
  • Exercise financial and administrative control as per the established delegation of powers.
  • Keep liaison with counterparts in order SCAs local and other departments of agriculture, agricultural university, governments, institutions, seed producing agencies etc.

Chief Seed Certification Officer:

  • Be the second in command and assist the Director in the discharge of his duties.
  • Have overall supervision of the working of all SCA staff in HQ and RO.
  • Undertake supervisory inspection.
  • Directly control the SCA’s grow-out test activities.
  • Coordinate the activities of ROs and arrange for compilation of relevant date information statistics etc.
  • Examine complaints and ensure their amicable settlement without sacrificing seed quality.
  • Regularly review the policies, principles and producers and submits suitable proposals.
  • Study the working arrangements, records land reports and develop appropriate proposals for improving them.
  • Prepare proposals for GB and CSCB and follow up.
  • Liaison with counterparts in the related institutions, and
  • Implement educational and promotional programme including periodical meetings, training programmes, field visits etc. for SCA staff and producers.

Senior Seed Certification Officer:

  • Overall management, administration and supervision of certification activities within the jurisdiction of RO.
  • Arrange for supply and receipt of applications for certification and follow-up.
  • Undertake regular inspections of all area under foundation class and supervisory, inspection for certified class in the RO.
  • Represent the SCA in the breeder seed quality monitoring and participate in team’s inspections,
  • Inspect seed processing plants and report observations to H.Q. to decide on approving them.
  • Assist the CSCO in the grow out testing activities.
  • Examine and investigates complaints and take appropriate action without sacrificing seed quality.
  • Ensure adequate feed back from Branch Office to Head Office.
  • Maintain liaison with counterparts in related departments, institutions etc. involved in certification programmes.

Seed Certification officers/ Field Assistants/ Agriculture Extension Officers:

  • Verification of the authenticity of the foundation seed and the eligibility of the field for seed production with regard to isolation distance and crop grown in the previous season.
  • Carry out the requisite number of field inspections as per Indian Minimum Seed Certification Standards and field standards.
  • To supervise the working of the seed processing plants like cleaning seed treatments and bagging etc.
  • To take up samples and sending them to seed testing laboratory for testing physical purity and germination and other pathological tests after observing various formalities.
  • To undertake the revalidation work to carry over certified seed as per prescribed procedures.

Office Superintendent:

  • Office/ Branch supervisions.
  • Posting and transfers.
  • Maintenance of ACR’s reports/ dossiers/ sanction of Casual leave of all staff
  • Assembly business file.
  • Maintenance of attendance register .
  • Correspondence of MLA’s/ Ministers/ VIPs
  • Checking of all bills

Accountant/ Senior Assistant:

  • Preparation of budget.
  • Audit, settlement of audit paras.
  • Preparation of accounts and maintenance of ledgers.
  • Preparation of contingent bill.
  • All office establishment/ court cases /Misc. correspondence.
  • Checking of all bills

Junior Assistant:

  • Handling of cash, cash book.
  • Maintenance of GPF/ EPF account.
  • Monthly income and expenditure statement
  • Preparation of Pay, T.A., Medical  bill.
  • Correspondence regarding Tour programme of staff, maintenance of Telephone, diary & dispatch, postage stamps account, weekly statement, typing work.

Correspondence regarding appointment of daily paid staff, Muster-roll and other misc. office duties as assigned from time to time by the Director.

 



CHAPTER-III

PROCEDURES FOLLOWED IN THE DECISION-MAKING PROCESS, INCLUDING CHANNELS OFSUPERVISION AND ACCOUNTABILITY

Seed Certification Standards are necessary for ensuring the quality of seed. Seed Certification Standards which are enforced in the country have been classified into two categories
A. General Seed Certification Standards:
B. Specific Seed Certification Standards:
A . General Seed Certification Standards: These standards are common for all the crops which are eligible for certification. The important general seed certification standards are: eligibility requirements for certification of crop varieties, classes and sources of seed, phases of certification, field inspection, harvesting and threshing, seed processing, sampling of seeds, seed analysis report, seed standards of genetic purity, grow-out test, seed standards for insect damage, etc.
B. Specific seed certification standards: These standards are for maintaining genetic purity and quality of seeds and applicable for individual crops or a group of crops separately. These specific standards are of two kinds i.e. field standards and seed standards.
Field Standards are those standards which affects the genetic as well as physical purity and seed health of the standing crop. The various field standards are:

CHAPTER-V

THE RULES, REGULATIONS, INSTRUCTIONS, MANUALS AND RECORDS HELD BY THE COMPANY OR UNDER ITS CONTROL OR USED BY ITS EMPLOYEES FOR DISCHARGE OF FUNCTIONS

GENERAL SEED CERTIFICATION
STANDARD

Rules

Certification Agency: The State Government or the Central Government in consultation with the State Government, by notification in the official Gazettee establish a Certification Agency for the State to carry out the functions entrusted to the certification agency by or under this Act.

Grant of Certificate by Certification Agency:

1. Any person selling, keeping for sale, offering to sell, bartering or otherwise supplying any seed of any notified kind or variety may, if he desires to have such seed certified by the Certification Agency, apply to the certification agency for the grant of a certificate for the purpose.

2. Every application under sub-section (1) shall be made in such form, shall contain such particulars and shall be accompanied by such fees as may be prescribed.

3.On receipt of any such application for the grant of a certificate, the certification agency, may after such enquiry as it thinks fit and after satisfying itself that the seed to which the application relates conforms to the minimum limits of germination and purity specified for the seed under clause (a) of section 6, grant a certificate in such forms and on such conditions as may be prescribed.

Revocation of Certificate:

If the certification agency is satisfied, either on a reference made to it in this behalf or otherwise that:

(a The certificate granted by it under section 9 has been obtained by misrepresentation as to an essential fact, or

(b The holder of the certificate has, without reasonable cause, failed to comply with the conditions subject to which the certificate has been granted or has contravened any of the provisions of this Act or the rules made  thereunder; then without prejudice to any other penalty to which the holder of the certificate may be liable under this Act, the certification agency may after giving the holder of the certificate a opportunity of showing cause, revoke the certificate.

Appeal:

  1. Any person aggrieved by a decision of a Certification agency under Section 9 or Section 10 may within 30 days from the date on which the decision is communicated to him and on payment of such fees as may be prescribed, prefer an appeal to such authority as may be specified by the State Government in this behalf:

    Provided that the appellate authority may entertain an appeal after the expiry of the said period of 30 days if it is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time.
  2.  On receipt of an appeal under Sub-section (1) the appellant authority shall, after giving the appellant an opportunity of being heard, dispose of the appeal as expeditiously as possible.
  3. Every order of the appellate authority under this section shall be final.      

                    

HIMACHAL PRADESH

SEED CERTIFICATION RULES

1.         Short title State seed Certification Agency.
            These rules may be called the rules of the Himachal Pradesh State seed Certification Agency,1978.

2.         Definitions  In these Rules, unless the context otherwise requires:-

a)           “Board” means the State Seed Certification Governing Board.

b)          “Chairman” means the Chairman of the Board.

c)           “Director” means the Director of the State Seed Certification Agency.

d)          “Member Secretary” means the Member Secretary of the Board.

3.        Authorities of the Agency   The authorities of the Agency shall be:-

           a)       The Chairman

           b)       The Board.

           c)       The Director

           d)       Such other authorities as may be constituted by the Board to give effects to the provisions of the memorandum of Association of the Agency and these rules

4. The Director shall be the Chief Executive Officer of the Agency.

5.              The Director shall be appointed by the Board on such terms and  conditions as may be approved by the Board.

6.               Member of the Board

i)The Board shall consist of the following members:-

a)  The Secretary (Agriculture) in the State who shall be the Chairman of the Board.

b) The Director of Agriculture or representative of the Department of Agriculture. 

c)  Two senior specialist on crop research of Himachal Pradesh University nominated by the State Government.

d) Two representative of the Seed Growers and one representative of the seed dealers to be nominated by the State Government.

e)  One representative to be nominated by the Central seed Certification Board.

f) The Director of Seed Certification, State Seed Certification Agency who shall be the Member-Secretary of the Board.

      ii) a) The first Board shall be as specified in clause-4 of the Memorandum of Association which will function for one year from the date of registration of the Agency.

b)     After the expiry of this period, Board shall be constituted as indicated in sub-rule (ii) provided  that any vacancy falling during the first year of the functioning, shall be filled in accordance withthe provisions of the rule 12 infra. 

7. Roll of Members  The Board shall keep a Roll of Members their names,  addresses and occupations and every member shall sign the same.

8.  If a member of the Board changes his address he shall notify his new address to the member-Secretary who shall thereupon enter his new address in the roll of members. But if he fails to notify his new address, the address given in the Roll of Members shall be deemed to be his address.

9 Duration of Membership    The term of the office of the members of  categories shall be two years and a retiring member shall be eligible for re- nomination for one more term.

10.            A member of the Board shall cease to be a member thereof if:

a)      he dies, resigns, becomes of unsound mind of becomes insolvent or is convicted of a criminal offense involving moral turpitude, or

b)      being a member by reason of the office of appointment he holds, cease to hold that office or appoint;

c)      he does not attend three consecutive meetings of the Board without proper leave of the Chairman, or

11.   A resignation from the membership of the Board may be tendered to the Chairman and shall not take effect until it has been accepted by the Chairman .

12. The vacancy in the membership of the Board caused by any of the reasons mentioned in Rule 10 shall  be filled up in accordance with the provision of these rules. But the person appointed in the vacancy  shall hold  office only for the unexpired period of the terms of the membership.

13 The Board shall function not withstanding that any person who is entitled to be a member by virtue of his office, is not a member of the Board for the time being not with standing any other vacancy in Board whether by non-appointment, a defect in appointment or otherwise and no act of proceedings of the Board shall be called in question on the ground merely of the existence of any defect in the consultation of the Board. 

14.  Proceedings of the Board     

a)      The annual general meeting of the Board shall be held such time date and place as may be determined by the Chairman. 

b)      The Chairman may convene a general meeting of the Board whenever he thinks necessary. However, the Board shall hold at least four general meetings every year.

c)      Six members of the Board may, by a letter addressed to the Member Secretary, requisition a special meeting of the Board. On receipt of such requisition the Member-Secretary shall convene a meeting.

15. Except as otherwise provided in these Rules, all meetings of the Board shall be called by notice under the signature of the Member Secretary or any officer authorized in this behalf by the Chairman.

16 Every notice calling a meeting of the Board shall state the date,  time and place at which meeting will be held shall be served upon every member of the Board not less then fifteen days before the day appointed  to annual or ordinary general    meetings and seven days for a special.

17 Every meeting of the Board shall be presided over by the Chairman. If the Chairman is not present at meeting of the Board the meeting will be presided over by the Vice-Chairman if both the Chairman and Vice Chairman are not present, the members present will elect a Chairman for the meeting. 

18 Six members shall form the quorum at any meeting of the Board.

 Provided that, if a meeting of the Board is adjourned for lack of quorum and then meets again to transact the same business, after due notice as provided for in Rule 16 no quorum shall be necessary

19.All disputed questions at the meetings of the Board shall be determined by vote. In case of any equality of votes the Chairman shall have casting vote.

20. The Member Secretary shall keep a record of the proceedings of the meetings of the Board and a copy thereof shall be sent to the State Govt., the Central Seed certification Board, and the Agriculture University etc.

21.  Powers of the Board    The Board shall have the power to frame regulations, not in consistent with these rules the Agency and for carrying out the objectives.

i)  the preparation and sanction of budget estimates, the sanctioning & expenditure, making and execution  of contracts, the investment of the  funds of the Agency and accounts and audit.

ii) Procedure for appointment of the officers and other staff of the Agency.

iii) Powers functions and conduct of business of committees as may be constituted from time to time.

22.Bye-Laws  The Board may frame bye-laws which are not inconsistent with the memorandum of Association, Rules and regulations for carrying out the purpose of the Agency and for its day to day administration.

23. Subject to the Memorandum of Association, Rules and regulations, the Board shall have the power.

a)  to appoint all categories of officers and staff for conducting the affairs of the Agency consistent with qualifications specified by the Central seed Certification Board, to fix the amount of their remuneration subject to the budget provision and to define their duties.

b) To enter into arrangement with the Govt. of India, State Govt. and other public or private organizations of individuals for furtherance of its objectives. For implementation of its programme and for securing and accepting endowments, grants-in-aid donation or gift on mutually agreed term and conditions;

Provided that the conditions of such grant-in-aid contains or gifts shall not be inconsistent or in conflict with the objectives of the Agency with the provisions of these Rules.

c)   to establish and collect fees for services provided by the Agency which are not inconsistent with provision of the Seed Act and Rules or recommendations of the Central Seed Certification Board.

d) To acquire by gift, purchase, lease or otherwise any property, movable or immovable, which may be necessary or convenient for the purpose of the Agency and to construct after and maintain any building or buildings for the purpose of the Agency.

e)To draw, make accept, endorse, discount and negotiate with State Govt. of India and other promissory notes bills of exchange, cheques or other negotiable instruments.

f)to invest the funds of the Agency in such securities or in such manner as may, from time to time, be determined by the Board and from time to time sell or transfer such investment;

g)to take over and acquire by purchase, gift or otherwise from Govt. and other public bodies or private individuals, movable and immovable properties or other funds together with any attendant obligations and engagements not inconsistent with the objects of the Agency.

Note:   The powers under (b), (d) and (g) shall be exercised by the Board  subject to the conditions that the prior approval of the Government of India shall be obtained for accepting any gift or  assistance in any form from foreign governments/ organizations and international agencies or for entering into any negotiations or  contractual arrangements with them and

  h)  to sell transfer, lease or otherwise dispose of any movable or   immovable property of the Agency  shall be sold or transferred without the prior approval of the State Government

24. The Board may delegate to the Chairman, any of its members, and to the Member Secretary or to another officer of the Board such administrative and final powers or impose such duties as it may  deem proper and also prescribe limitations within which powers are to be exercised or duties to be performed.

25.  The Board may be Resolution appoint:-

a) Committee or sub-committee for such purpose and with such powers as it may think proper and.

b)Advisory Committees, or panels consisting of persons who need not necessarily be the members of the Board with such advisory functions as the Board may think proper. The Board may dissolve any of the Committee or sub-committees at any time.

26. Functions of the Board: The Board shall take such action to:

a)    employee the full compliment of a qualified staff or the Agency
b)    arrange for suitable office space for its and the Agency’s  headquarters.
c) assure that the staff has adequate equipment, mobility and supplied to carry out the responsibilities entrusted to it.
d)recognize authentic sources of breeders and foundation seed.
e)  Consider matters of concern and specific certification problem cases submitting to it by the Director.
f)  Ensure the development of a sound and comprehensive seed certification programme in the State in consultation with the university if existing the State Department and seed producers organizations.
g) recommended to the Central seed Certification Board modification in seed certificational standards and procedure.
h)  develop and educational programme emphasizing use of good quality seed or recommended varieties.
i)  Provide the Central seed Certification Board with a description of all State Developed varieties so that it may make the information available to all other agencies.
j)  maintain close liaison with similar Board and agencies of other States and to keep in touch with seed law enforcement and seed testing programmes in the State and the country.

27. Functions and Powers of the Director: Subject to any directions that may be given by the Board, the Director shall functions as Chief Executive Officer of the Board and shall be responsible for the proper  administration of affairs of the authority under the direction and guidance of the Board.

28 Funds of the Agency    The funds of the Agency shall consist of the following:             

     a)  grants make by the Govt. of India and the State Govt.
     b)contributions from other sources;
     c)income from the assets of the Agency;
     d)receipts of the Agency by way of application and certification fee and other service  charges.

29. The funds of the Agency shall be deposited in a Nationalised/ Co-operative Banks. All the funds shall be  paid to the account of the authority with such Bank shall not be withdrawn except through a cheque signed by such officers or  officer of the Agency as may be duly empowered in this behalf by the Board and countersigned by the Director or a member or members of the Board authorized in this behalf by the Chairman.

30. The Board may appoint a financial advisor-cum- Accounts Officer for the Agency, to supervise and             manage the account be examined by the Financial Advisor for his advice before these are actually implemented. In  case the implementation of any such proposals is, by virtue of any advise tendered by the Financial Advisor is not acceptable to him the matter shall be referred to the Board of for a final  decision.

31.    Accounts, Audit and Annual Report:

a) The Agency shall maintain proper accounts and other relevant records and prepare annual accounts compromising liabilities etc. in such form as may be prescribed by the Board in consultation with the Auditors.
b)The accounts of the Agency shall be audited by the Auditors appointed by the Board and any expenditure incurred in connection with the audit of accounts of the Agency shall be payable by the Agency.
c) Or any other person appointed by him in this behalf, as in connection with the audit of Govt. accounts and in particular, shall have the right to demand the production of books, accounts contacted vouchers and other documents and papers to inspect any of the officers or institutions of the Agency.
d) The accounts of Agency, as certified by the auditors together  with the Audit report

32.  An annual report of the proceedings of the Agency and of the work under taken during the year shall be prepared and published for the information of the Board, Central Seed Certification Boards, State Govt. Agricultural University, Seedsmen and other concerned and interested.

33.  Amendment of Rules: Subject to the provision of the Society Registration Act,1860 (of 1860), these  rules may be amended at any time by the resolution passed at an ordinary general meeting of the board duly convened for the purpose and supported by more than half of the total number of  members of the Board.

34. General:  The authority shall be subject to all the provisions of the Societies Registration Act,1860 (Act XXI of 1860) as amended by the______of  1957 and as applied to_________.

35.The Society shall sue and be sued in the name of the Director of the Agency.

36.Dissolution: Subject to the provisions of the Societies registration Act 1860 (XXI of 1860) and with the approval of the State Govt. the Society may be dissolved by a Resolution passed  an ordinary general meeting of the Board duly convened for the purpose and supported by more then three fifth of total number of member of the Board. On such dissolution, all assets and liabilities of the Society shall vest in the State Govt. and shall be dealt with in such manner as State Govt. may direct.

H.P.STATE SEED CERTIFICATION AGENCY

MEMORANDUM OF ASSOCIATION

    

 In the matter of the Registration of Societies Act,1860 (Act of 1860) being an Act for the registration of Literary Scientific and Charitable Societies.

And

In the matter of State Certification Agency

          Memorandum of Association:

1.The name of the Society shall be the Himachal State seed Certification Agency (hereinafter referred to as the Agency). It will be a non-profit making body.

2. The registered office of the Agency shall be situated at such place as the State Seed Certification Board may decide from time to time. Its office at present will be located at Shimla but its area of operation will be the  whole of the State.

3.The objects for which the Agency is established are:

a)  to act as the Certification Agency established under Section 8 of the Seeds Act,1966 (54 of 1966);
b) to discharge the functions entrusted to the certification agency under Section 9 and 10 of the Seeds Act 1966 (54 of 1966);
c)diffusion of scientific knowledge regarding standardization of seed according to the national/ international standards;
d)to recognize varieties (and kinds where improved varieties are not available) eligible for seed certification and publish annually lists indicating the names of such varieties and kinds;
e)  to maintain a list of sources of breeders and foundation seeds approved by the Central Seed Certification Board in the case of variety grown in more than one State and by the State Seed Certification Board in the case of varieties of local importance;
f) to verify upon receipt of an application for certification that the variety is eligible for certification, that the application has been submitted in accordance with the procedure prescribed by the State seed Certification Board and that the source of seed used for planting is from approved sources.
g) To provide for the inspection of seed fields, seed processing plants and seed lots in accordance with the procedures outlined by the Central seed Certification Board.
h)To ensure that the seeds certified in the state conform to the standards prescribed by the Central seed Certification Board;
i) To grant certificates, certification tags and seals etc., designed as per specifications provided by the Central seed Certification Board and as per procedure prescribed by the State seed Certification Board;
j)To carry out educational programmes designed to promote the use of certified seed including a publication listing cooperators in the seed certification programme and sources of certified seed and provide such information to the Central seed Certification Board and to publicise the same.

4. The names, addresses and occupations of the first, members of the State Seed Certification Governing Board to whom by the rules and regulations of the agency, the management of the Authority’s affairs is entrusted are  given below:

SEED CERTIFICATION RULES

1. Short title State seed Certification Agency.

These rules may be called the rules of the Himachal Pradesh State seed Certification Agency,1978.

2.  Definitions  In these Rules, unless the context otherwise requires:

e) “Board” means the State Seed Certification Governing Board.

f)  “Chairman” means the Chairman of the Board.

g) “Director” means the Director of the State Seed Certification Agency.

h) “Member Secretary” means the Member Secretary of the Board.

3 Authorities of the Agency   The authorities of the Agency shall be:-

           a) The Chairman
           b)  The Board.
           c)  The Director
           d)  Such other authorities as may be constituted by the Board to give effects to the provisions of the memorandum of Association of the Agency and these rules

4.   The Director shall be the Chief Executive Officer of the Agency.

5.The Director shall be appointed by the Board on such terms and  conditions as may be approved by the Board.

6.   Member of the Board

j)  The Board shall consist of the following members:-
g)  The Secretary (Agriculture) in the State who shall be the Chairman of the Board.
h)  The Director of Agriculture or representative of the Department of Agriculture. 
i) Two senior specialist on crop research of Himachal Pradesh University nominated by the State Government.
j) Two representative of the Seed Growers and one representative of the seed dealers to be nominated by the State Government.
k)  One representative to be nominated by the Central seed Certification Board.
l) The Director of Seed Certification, State Seed Certification Agency who shall be the Member-Secretary of the Board.
      ii) a)   The first Board shall be as specified in clause-4 of the Memorandum of Association which will  function for one year from the date of registration of the Agency.
          b) After the expiry of this period, Board shall be constituted as indicated in sub-rule (ii) provided that any vacancy falling during the first year of the functioning, shall be filled in accordance withthe provisions of the rule 12 infra. 

7. Roll of Members  The Board shall keep a Roll of Members their names,  addresses and occupations and every member shall sign the same.

8.  If a member of the Board changes his address he shall notify his new address to the member-Secretary who shall thereupon enter his new address in the roll of members. But if he fails to notify his new address, the address given in the Roll of Members shall be deemed to be his address.

9.Duration of Membership    The term of the office of the members of  categories shall be two years and a retiring member shall be eligible for re- nomination for one more term.

10.   A member of the Board shall cease to be a member thereof if:     

d) he dies, resigns, becomes of unsound mind of becomes insolvent or is convicted of a criminal offense involving moral turpitude, or
e) being a member by reason of the office of appointment he holds, cease to hold that office or appoint;
f) he does not attend three consecutive meetings of the Board without proper leave of the Chairman, or

11.  A resignation from the membership of the Board may be tendered to the Chairman and shall not take effect until it has been accepted by the Chairman .

12.   The vacancy in the membership of the Board caused by any of the reasons mentioned in Rule 10 shall  be filled up in accordance with the provision of these rules. But the person appointed in the vacancy  shall hold  office only for the unexpired period of the terms of the membership.

13.The Board shall function not withstanding that any person who is entitled to be a member by virtue of his office, is not a member of the Board for the time being not with standing any other vacancy in Board whether by non-appointment, a defect in appointment or otherwise and no act of proceedings of the Board shall be called in question on the ground merely of the existence of any defect in the consultation of the Board. 

14. Proceedings of the Board     

d)The annual general meeting of the Board shall be held such time date and place as may be determined by the Chairman. 

e)      The Chairman may convene a general meeting of the Board whenever he thinks necessary. However, the Board shall hold at least four general meetings every year.

f)  Six members of the Board may, by a letter addressed to the Member Secretary, requisition a special meeting of the Board. On receipt of such requisition the Member-Secretary shall convene a meeting.
